Portara LLC, 8 The Green, Suite A, Dover, DE 19901 ("Portara") licenses the historical market data you are buying ("the Data") to you and, if you are buying for a business, that business (together "you"). It is delivered once, as a download of CSV files. No updates, software or support are included.
1. Your license
Perpetual, non-exclusive, non-transferable. The Data is licensed, not sold; Portara and its data originators keep all rights in it.
2. Delivery
Your download link will be active for 7 days from purchase. After that, except under arranged circumstances, your data will self-delete from our servers and will be gone forever, without any further way of retrieval, so please keep your data safe.
3. Where you may use it
Within your organization, on your own computers, servers or cloud instances, with backups as you see fit.
4. What you may do
Research, backtesting, model and AI training, live trading. You may publish results, charts, signals and performance figures derived from the Data.
5. What you may not do
Pass the Data — or anything from which it could be substantially reconstructed — to anyone outside your organization. Include it in any product, dataset, feed or service offered to others. Use it to build, populate or improve any service that supplies market data to third parties. Redistribution licenses may be available separately on request. If you do any of these, this license ends and you must delete the Data.
6. Not transferable
This license does not pass by assignment, merger, change of control or sale of assets. An acquirer of your business needs its own license.
7. Warranty
THE DATA IS PROVIDED "AS IS" AND "WITH ALL FAULTS", WITHOUT WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Portara is not the originator of the data and no historical database is error-free. If a file we delivered is corrupt or incomplete compared with what you ordered, tell us within the 7-day download period and we will re-issue it; that is the only remedy. Whether a file is corrupt or incomplete is determined at Portara's sole discretion. The Data is a digital product delivered in full at purchase and is not refundable.
8. Data matching
Portara has a very strict policy on data matching to other suppliers. If you intend to do this that's fine, but Portara cannot get involved in any form of discussion or comparison of our data with other data providers — including online charts, analytics websites, brokers and backtesters, whether via free online data, paid services, exchange data or otherwise. It is important to realize that ALL data will vary to some degree between suppliers for very many reasons, and no matter what you find, the data is what it is and cannot be changed anyway. 9. Liability
The Data is not investment advice; how you use it is your responsibility. To the fullest extent the law allows, Portara and its data originators accept no liability of any kind arising from the Data or your use of it, including trading losses, lost profits and indirect or consequential loss. If any liability cannot be excluded by law, it is limited to re-supplying the original data set AS-IS, and no claim may be brought more than one year after it arose.
10. Your rights under local law
Nothing in this license excludes any right that the law of your country does not allow to be excluded. Where such a right applies, our liability is limited to re-supplying the original data set AS-IS.
11. Law
This license is governed by the law of the State of Delaware, USA. If any part of it turns out to be unenforceable, the rest still applies.
